The lawyer who's won an 11th hour court injunction to delay the transfer of asylum
seekers to Malaysia insists the case is a matter of life or death.
The first group of asylum seekers to be flown out under the so-called Malaysia solution
were due to depart this morning.
But that's been delayed until at least 4.30pm (AEST) after solicitor DAVID MANNE from
the Refugee and Immigration Legal Centre obtained an injunction in the High Court yesterday.
A hearing is set for 2.15pm.
Mr MANNE's told the Seven Network they're very vulnerable people and they're just asking
whether the government has the power to refuse them the ability to have their case for
refugee protection heard here.

TWEED HEADS, NSW, Feb 17 AAP - Tweed Shire councillors who think developers expect
nothing in return for election donations also believe in fairies, a former mayor told
an independent inquiry today.
A controversial election fund was referred to as a "pot of gold" and questions were
raised over the amount of business conducted in private as the public hearings continued
into whether developers have undue influence over Tweed Shire Council.
A 40-year veteran of the council who served 13 terms as mayor and president, Councillor
Max Boyd told the inquiry he refused donations because he did not want to be in the debt
of developers.
"If you believe that business people do this for nothing. If you believe that, you've
got to believe in fairies at the bottom of the garden," he said.
The inquiry, headed by commissioner Maurice Daly, opened sittings in Tweed Heads this
week into allegations the far northern NSW council was improperly influenced by developers
involved in a current $5 billion coastal property boom.
A lobby group, Tweed Directions, raised $340,000 from developers to fund advertising
and election campaigns for selected councillors at the 2004 poll.
Six pro-development councillors were elected and hold the majority in council.
In submissions to the inquiry, Mr Boyd said developer Metricon was a $20,000 donor
and was seeking approval for a shopping centre and residential development in the shire.
Pro-development councillor and deputy mayor Lynne Beck admitted laying out a welcome
mat for developers in recent years to encourage investment and job creation.
She met weekly with Tweed Directions' founders, developer Allan Blundell and Gold Coast
public relations consultant Graham Staerk, but said she had no idea where the donated
money came from and that there were no expectations.
"It was just a pot of gold?" asked officer assisting the inquiry, Angus Broad.
"Or the goose that laid the golden egg," replied Ms Beck.
The councillor and her pro development team received $22,050 from Tweed Directions
for the 2004 campaign.
Mr Boyd rejected the notion that councillors were unaware of the source of the donations.

Skeletal remains have been found by a creek in Sydney's west .. but it's not known
if the bones are human.
The bones were discovered late yesterday by a local at Prospect Creek .. near Bell
Crescent in Fairfield.
A pathologist will examine the remains .. and police have established a crime scene at the creek.

The man who came last in the South Australian Liberal deputy leadership challenge looks
set to win the job today.
Despite almost toppling Labor in the election just two weeks ago .. the opposition
has been in turmoil over the past week since former leader MARTIN HAMILTON-SMITH was elected
deputy.
It was expected Mr HAMILTON-SMITH and water spokesman MITCH WILLIAMS would face off
at today's party room meeting .. despite Mr WILLIAMS not even making the final round in
last week's vote.
But the former leader has confirmed he's withdrawn from the race with Mr WILLIAMS.
ISOBEL REDMOND .. who was re-elected unopposed last week to head the opposition ..

Qld: Bank manager injected, cash stolen
A Gold Coast bank manager's been abducted and injected twice in the neck with an unknown
substance in an elaborate robbery.
Police are seeking two men who dressed as construction workers to accost the manager
of the Mudgeeraba branch of the Bank of Queensland this morning .. as he was parked on
the side of the road.
The 49-year-old was threatened with a silver automatic pistol and a syringe .. and
injected twice in the back of the neck as the men told him what they wanted him to do.
The manager went to the bank .. withdrew a quantity of cash from the safe and dropped
it off in a garden about 200 metres away from the bank.
Police say the bank manager .. who called police after the drop off .. has been traumatised
by the incident and is awaiting test results in relation to the injections.

SYDNEY, Dec 9 AAP - Mark Catchpole, the son of former Wallabies legend Ken Catchpole,
is fighting to have the more serious drug charges against him dropped.
Catchpole, 40, is facing 13 drug and weapons charges, including supplying ecstasy,
dealing in the proceeds of crime and several firearm offences.
In Sydney's Downing Centre Local Court on Tuesday, his barrister, William Barber, asked
the Department of Public Prosecutions (DPP) to withdraw charges of possessing a pill press
and dealing in the proceeds of crime.
Chief Magistrate Graeme Henson encouraged the DPP to make a decision about Catchpole's
application by December 23.
"Christmas cheer will go out the door if I am asked to turn up simply to make an adjournment,"
Mr Henson said.
"Ho ho ho."
Outside court, Mr Barber told reporters if the major charges were dropped his client
would "be here for a very few minor matters".
He said the NSW Crime Commission had frozen all Catchpole's bank accounts and taken
his car, putting his life on hold.
"Hopefully on the 23rd his life can get back to normal," Mr Barber said.
"Unfortunately, if we are successful here (in having the charges dropped) we will still
have to fight the crime commission to unfreeze his accounts."

SYDNEY, Aug 5 AAP - The NSW government is expected to offer a reward to help find Rachelle
Childs' killer after a coroner found the Sydney woman was murdered.
Changes in the way police handle suspicious deaths in the first two days have also
been recommended after the inquest at Glebe Coroners Court.
The charred, partially-clad body of Ms Childs, 23, was discovered in roadside bushes
at Gerroa, on the NSW south coast, in June 2001.
Ms Childs was last seen alive driving towards Bargo the night before her body was found.
Deputy State Coroner Jane Culver today found she had been murdered.
"Any possibility of accidental death is unlikely," she said.
Ms Culver found that the cause of death was undetermined due to the condition of the body.
It is understood the NSW government will later today offer a reward for information on the case.
Ms Culver said one vital piece of evidence was missing.
"Rachelle Childs' killer has not yet been apprehended," she said.
"I urge the public to continue their calls (to Crime Stoppers)."
Ms Culver also made several recommendations about the way investigations of suspicious
deaths are handled by NSW Police in the first 48 hours.
"The police investigation in the early period following Ms Childs death unfortunately
did not capture some items of evidence which are no longer available to the current investigating
police," she said.
"To avoid a similar situation occurring ... it is recommended that the NSW Police Force
conducts a review of its procedures regarding the notification to the Homicide Unit of
suspicious deaths and the subsequent investigation of such matters."
Speaking outside the inquest, Ms Childs' father Graham Childs urged anyone with information
about the final few days of his daughter's life to come forward to police.
He said information had been received as late as last week and there were people out
there who assumed police had information, which wasn't the case.
"The pieces of the puzzle are there," he told reporters.
"All you need is one little piece of evidence."
Mr Childs said he welcomed the reward, but it shouldn't be necessary to get a member
of the public to come forward.
"I'm not optimistic. I've grown more frustrated," he said.
"I'm still hopeful."
"My greatest fear is that we do find this murderer and that greatest fear is we find
out because he's done this to somebody else."

An Australian study has found taking calcium tablets can reduce an older person's chance
of breaking a bone by up to a quarter.
The study .. conducted by NSW and victorian researchers .. is one of the biggest ever
to work out the benefits of mineral supplements to prevent bone loss or fractures caused
by osteoporosis.
The disease affects one in three women and 20 per cent of men .. and while calcium
and vitamin D are widely considered beneficial .. the research has been conflicting.

SYDNEY, April 10 AAP - A coroner is investigating the standard of medical care provided
to a Sydney schoolgirl who died in hospital after she was hit in the head by a golf ball.
Vanessa Anderson, 16, died on November 8, 2005, two days after her skull was fractured
in an incident at Asquith Golf Club, in Sydney's north-west.
The teenager was struck on the right side of the head by a ball during an under 18's
golf competition.
She was taken to Royal North Shore Hospital but before she could undergo planned surgery,
suffered a seizure and died, Glebe Coroners Court was told in an opening statement today.
Deputy NSW Coroner Carl Milovanovich heard that Vanessa was not given any anti-convulsant
medication after her admission to hospital.
However, she was given increasing amounts of pain killers and after her death, four
times the therapeutic level of codeine was found in her system.
Mr Milovanovich also heard that a nurse failed to notify doctors of significant changes
in Vanessa's condition - including loss of movement and memory - in the hours before her
death.
In a statement to the court, the hospital acknowledged that "there were flaws in the
care" provided to Vanessa.
Questioned about the hospital's statement outside court, Vanessa's father Warren Anderson
said for "a person that's lost their daughter it's shallow".
Mr Anderson told reporters the inquest was "gut wrenching" for him and his wife but
he was fighting to ensure hospitals were safe places.
"I've said from the word go, it's a comedy of errors and I just don't want any other
family going through what we're going through."
The inquest continues.

SYDNEY, Dec 8 AAP - A Sydney man will face court today on charges relating to a hydroponic
cannabis crop discovered in the Blue Mountains.
Police said they raided a house in Gladstone Street, Leura, about 9am (AEDT) yesterday
and allegedly seized 88 cannabis plants and sophisticated hydroponic equipment.
A 32-year-old man from North Turramurra, in Sydney's north, was arrested at the scene
and charged with cultivating a commercial quantity of cannabis plants, supplying a prohibited
drug, goods in custody suspected of being unlawfully obtained and possessing prohibited
drugs.
He was refused bail and will appear in Lithgow Local Court today.

Dear Dr. Gott: I recently read an article on the Internet regarding the healing powers of asparagus. It is supposed to really be a super cancer-killer. Have you heard anything about this, or is it more Internet hype? It seems to me that if it is all it is said to be, the AMA or FDA would be endorsing it, wouldn't they?
Dear Reader: Asparagus contains a protein known as histone, believed to be active in controlling cell growth. This may be the connection to which you refer. It is high in folate and vitamins K and C, and may provide the digestive tract with unique health benefits. It is purported to fight depression, lower cholesterol, contain antifungal and antiviral qualities, prevent kidney stones and bladder and urinary tract infections, reduce high blood pressure, treat toothaches, increase the success rate of chemotherapy, and contain anti-cancer agents — particularly in relation to the lungs.
In one circulating e-mail, The Cancer News Journal was said to have printed an article in December 1979; however, to date, the article and its biochemist author have not been found. The e-mail goes on to say the article discussed the miraculous tales of serious bouts of cancer being overcome by asparagus therapy. Asparagus is high in glutathione, an antioxidant purported to defend the body against viruses, certain forms of cancer and to boost immune cells. In recent years, large-scale, randomized clinical trials reached inconsistent conclusions."
Johns Hopkins' Kimmel Cancer Center has stated that poor diet and obesity associated with that poor diet are risk factors for the development of cancer. "However, there is no evidence that certain foods alter the environment of an existing cancer at the cellular level, and cause it to either die or grow."
This leads me to believe the jury is out on this decision and much more research is vital before conclusions can be reached. "While it's not surprising that Germany and the UK have the most online shoppers, since they have the most people online, it's interesting that the number of shoppers isn't proportionate to the number of users. It's far more than you'd expect," said Dan Stevenson, analyst at Jupiter. "The Internet market is more mature in these countries, so a lot more people feel comfortable buying things online."
Electronic greetings cards sites also experienced a pre-Christmas boom. As well as the established US site bluemountain.com, egreetings.com in the UK, epost.de in Germany and carteexpress.com in France also increased their audience.

Comic book publisher Chris Ecker loves to give comics away to kids, but he has one rule.
"When we're at (comic book) conventions I say, 'You can keep this comic, but you have to roll it up and stick it in your back pocket,' " Ecker said.
That may come as a shock to most collectors these days in an era when the first appearance of Superman in a comic book from 1938 is listed as being worth $175,000. Even some comic books from the '70s can be worth hundreds of dollars.
But Ecker, an Elgin resident who writes and draws for Big Bang Comics, said the comic book industry should get away from the collector mentality and get back to making comics fun again.
"The bad influence on kids today is actually their parents. They have been told to believe that the only value in comics is the potential collector value," Ecker said.
The problem is that most comic books do not appreciate significantly in value. It's a simple matter of supply and demand, Ecker said.
"If you make something that's in short supply and there's a demand, it will be valuable. But if no one cares about it, it's not valuable to anybody," Ecker said.
Ecker, who used to manage the Moondog's comic book chain throughout the Chicago area, remembers when Marvel Comics put out 8 million copies of X-Men No. 1 in 1991. That issue is listed as worth $2.50, or roughly what it cost in 1991, according to current collector guides.
The industry has slumped since the speculators of the early '90s have abandoned the market, Ecker said.
Ecker helped form Big Bang Comics with co-workers Gary Carlson and Ed DeGeorge a few years ago with a desire to make comic books fun again.
Two years ago, Big Bang joined the West Coast-based Image Comics, which has emerged as the largest independent comic book publisher in the market and is the creator of the character Spawn, which was brought to life in a recent film.
Big Bang's mission is a simple one, Ecker said.
"Gary and I have always been big fans of old comics. We grew up reading comics in the '60s and '70s and that's what we wanted to produce," Ecker said.
The Big Bang universe is populated by superheroes like Ultiman, "the Ultimate Human Being," and The Blitz, "the Quickest Man on the Face of the Earth." The resemblance to Superman and the Flash are intentional, Ecker said.
"That's why we deal with archetypes. It's to give people familiarity so they don't have to worry that if they miss 20 issues they won't know what's going on," Ecker said.
Ecker believes too many comic books today are geared toward an adult audience, which may be good for the bottom line today, but may cripple the business in the long run.
"We have hopes of developing a new market for comics even in the face of unbelievable competition from television, video games and the Internet," Ecker said. "But, you know, comics still work on a very primal level. It's a very personal entertainment medium where you supply the voices of the characters on the page. Also, you can take your time with them and you don't need a computer or any other special equipment, except maybe a flashlight to read them under the covers when your mom has told you to go to sleep."

BANK OF AMERICA EARNINGS PER SHARE RISE 23PCT.

CHARLOTTE, N.C., April 17 PRNewswire-AsiaNet - Paced by a 10 percent increase in revenue generated by widespread gains in most business lines, earnings at Bank of America Corporation (NYSE: BAC), whose stock is traded on the Tokyo Stock Exchange, increased 23 percent to $1.33 per share (diluted) in the first quarter from $1.08 a year earlier.
Net income increased 17 percent to $2.24 billion from $1.91 billion a year ago.
The return on common equity rose to 19.6 percent from 16.8 percent and the return on assets increased to 1.38 percent from 1.27 percent.
Cash-basis earnings - which exclude the amortization of intangibles - were $2.46 billion, or $1.46 per share, in the latest quarter. The return on average tangible common shareholders' equity was 30.8 percent.
"The growth in revenue and earnings this quarter demonstrates that our strategy to create more valuable customer relationships is beginning to show results," said Hugh L. McColl, Jr., Bank of America chairman and chief executive officer.
"We are gaining market share in many investment banking products as we meet more of our business clients' financial needs. Our customer retention continues to improve, and we are having good success in rewarding customers who bring more of their business to our company.

* New online banking enrollments increased to 125,000 per month, from a pace of 80,000 per month a year earlier, as total online retail customers rose to more than 2.1 million. Penetration increased to 14 percent of customers holding Bank of America checking accounts.
Visitors to BankofAmerica.com increased by more than 70 percent, and consumer loan products sold over the Internet increased by 300 percent from a year earlier.
* An alliance announced with Ariba intends to combine the Bank of America financial services engine with Ariba's leading business-to-business commerce platform resulting in a complete purchase-to-payment system for business-to-business commerce activities.
* Use of Bank of America Direct, the company's web-based cash management system, grew more than 500 percent from a year earlier.
First Quarter Financial Highlights (compared to a year ago)
* Total revenue climbed 10 percent, fueled by a 26 percent increase in non-interest income.
* Noninterest income rose to 47 percent of revenue driven by higher equity investment gains along with significant improvement in trading, investment banking and card income.
* The efficiency ratio improved more than 300 basis points to 53 percent.
Noninterest expense, excluding incentive compensation, was flat.
* Average managed consumer loans and leases increased 19 percent.
* Net charge-offs declined to an annualized .45 percent of loans and leases - an improvement of 13 basis points.
Net Interest Income
Fully taxable-equivalent net interest income of $4.60 billion was 1 percent below a year earlier, but 1 percent above the fourth quarter of 1999. Loan growth and higher levels of core deposits and equity did not fully offset the impact of asset securitizations and loan sales during 1999, spread compression and share repurchases.
Average managed loans and leases grew 9 percent to $406 billion, primarily reflecting a 19 percent increase in consumer loans and leases. Average domestic deposits grew by 2 percent, or $5.8 billion, to $295 billion. The net interest yield declined 31 basis points to 3.27 percent due to a higher level of lower-yielding trading-related assets and investment securities as well as spread compression and the cost of share repurchases.
Noninterest Income
Noninterest income increased 26 percent to $4.05 billion, reflecting the company's strategy to expand customer relationships through both traditional banking and other financial service products. Noninterest income rose to 47 percent of revenue from 41 percent a year earlier.
Trading profits were up 45 percent from last year's strong first quarter. Led by a 149 percent increase in securities underwriting fees, investment banking results rose 70 percent, reflecting the continuing benefits of the expansion of that platform begun last year.
Equity investment gains improved by $408 million, which included $219 million realized through sales and $189 million due to appreciation in fair value. Investment and brokerage services, corporate service charges and card income also improved significantly, as the company successfully pursued its strategy to gain more business through such value packages as Money Manager.
Securities gains were $6 million compared to $130 million in the first quarter of 1999.
Efficiency
Noninterest expense increased 4 percent to $4.62 billion, reflecting higher incentives associated with increased results as well as spending on projects to improve sales and service. These were somewhat offset by cost reductions resulting from recent mergers. Of the $201 million increase in personnel expense, $189 million was due to higher incentives. The efficiency ratio improved to 53 percent from 57 percent a year earlier.
Credit Quality
The provision for credit losses in the first quarter was $420 million, down from $510 million a year earlier. Net charge-offs were $420 million, down from $519 million a year ago. Net charge-offs were equal to an annualized .45 percent of loans and leases, a 13-basis-point improvement from a year ago.
Nonperforming assets were $3.48 billion, or .91 percent of loans, leases and foreclosed properties on March 31, 2000, compared to $3.12 billion, or .86 percent a year earlier. The allowance for credit losses totaled $6.83 billion on March 31, 2000, equal to 1.79 percent of loans and leases. The allowance was $7.12 billion, or 1.96 percent of loans and leases, a year earlier.
Capital Strength
Total shareholders' equity was $45.3 billion at March 31, 2000. This represented 6.90 percent of period-end assets of $656 billion.
In June 1999, the company initiated a share buyback program of up to 130 million shares. Through March 2000, 98 million shares had been repurchased, representing an investment in Bank of America stock of almost $6 billion. Average (diluted) common shares outstanding were 1.69 billion in the first quarter compared to 1.78 billion a year earlier.
Business Segment Results
Consumer and Commercial Banking, which serves individuals and businesses with annual sales of up to $500 million, earned $1.06 billion. This segment represented 47 percent of the company's net income.
Asset Management, which encompasses the private bank, trust, investment management, mutual funds and retail brokerage, earned $154 million, representing 7 percent of total net income.
Global Corporate and Investment Banking, which serves large corporate, institutional and government customers, earned $960 million, representing 43 percent of the company's earnings.

United Nations Development Programme and Cisco Systems Deliver Advanced Internet Education to Developing Countries in the Asia Pacific Region.

The UNDP Asia Pacific Development Information Programme (APDIP) and Cisco Systems, Inc. (Nasdaq:CSCO), announced today an innovative partnership to bring Internet education to students in developing countries in the Asia Pacific region.
APDIP and Cisco Systems will jointly fund and set up ten Cisco Networking Academies in nine developing countries in the region to provide students with advanced IT curricula to leverage the enormous opportunities created by the Internet while creating a qualified talent pool for building and maintaining networks.
The partnership between UNDP and Cisco Systems builds upon NetAid, a global project that harnesses the Internet to battle extreme poverty in the world. UNDP is the world's premier provider of grant assistance to improve living conditions for the poor in underdeveloped countries and Cisco Systems is the worldwide leader in networking for the Internet.
"The Networking Academy Program is a pivotal point in our vision to use the Internet to bring new opportunities to the developing world, and to find new tools to defeat poverty.
